THIS CONTRACT AND RELEASE AND HOLD HARMLESS (“Contract”) is between the undersigned photographer, Audra Mitchell and Audra Mitchell Photography and her associates (“Photographer”) and the undersigned Client, the parent of legal guardian of the child/children to be photographed.
HOLD HARMLESS
Client agrees to hold Photographer and her assigns harmless for any injury, disease, damage or trauma caused by production with the ducklings or injuries received at the shoot location, including being scratched or pecked by the ducklings or any injury, damage or trauma received on the premises. Client understands that ducks have the potential carry bacteria that can be transferred to humans such as salmonella and other disease. Hand wipes with sanitizer will be given after your session.
CARE AND HANDLING OF THE DUCKLINGS
Photographer will direct the child/children how to pet or pose with the ducklings. Only children over the age of 3 may hold the duckling with supervision. The ducklings may not at any time be mishandled in any way. Please make sure small children are coached not to pick the ducklings up by the neck or put them near their mouths.
If, after being properly warned, Photographer feels the child/children are not complying with the instructions of proper handling, the Photographer may terminate the session.
NO PAPARAZZI OR SELFIE PHOTOGRAPHY AGREEMENT
Photographer does not allow Clients or other family members or friends to photograph over her shoulder or otherwise during the photography session. This is distracting to the Photographer, and only images taken by Photographer are allowed. Likewise, Client may not take selfies at the photo session. If the Client continues to take photos of the subject after being warned by the Photographer, the Photographer may end the photography session with no further notice and will retain the deposit(s).
TODDLERS & CHILDREN
If you are bringing your toddlers or small children to be photographed, please make sure they are supervised throughout the photography session and do not run around or touch anything that they do not have permission to touch. My studio has thousands of dollars of expensive photography equipment in it, and if it gets broken, I have to ask you for replacement costs. Likewise, my props will look a lot like toys, but I ask that the children do not touch anything unless I give it to them. I hope you understand.
Consider a dash of mascara, tinted lip gloss or blush for your toddler or child.
Please try to sure your children have been fed and have had a nap and are in a good mood for their shoot. Bring their favorite toy or person that makes them smile. Also, bring a snack for them as well.
RELEASE
Client understands that the Photographer is the copyright holder of any images resulting from the production and may want to exercise her rights to use any or part of the images from the production as advertisement or in a portfolio. Photographer agrees not to sell or otherwise distribute Client’s images, except as aforementioned for portfolio purposes.
Client understands that the images may be altered or modified in any manner by the Photographer. Client hereby waives any right that Client may have to inspect and approve a finished product or the copy that may be used in connection with an image that the Photographer has taken of Child/Children, or the use to which it may be applied.
Client further releases the Photographer and his/her direct or indirect licensees and assignees, from any claims for remuneration associated with any form of damage, foreseen or unforeseen, associated with the use of the images.
Client states that they are of legal age and have the full legal capacity to execute this authorization without the consent or knowledge of any other person.
